1. Whatis an exparte contact? ”Ex parte” is a Latin term that means ”one si-ded,” and indicates that not all parties to an issue were present when it was discussed. An ex parte contact involving rulemaking is any communication between FAA and so-meone outside the government regarding a speci.c rulemaking proceeding, before that proceeding closes.A rulemakingproceedingdoesnotcloseuntil wepublish the .nal rule or withdraw the NPRM. Because an ex parte contact excludes other interested persons, including the rest of thepublic,from the communication,it maygive an unfair advantage to one party, or appear to do so.
2.Are written comments to thedocket exparte contacts? Written comments submittedtothedocket are not exparte contactsbecausethey are availableforinspection by all members of the public.
3.WhatisDOTpolicy on exparte contacts? ItisDOTpolicyprovidefor open developmentof rulesand toencouragefullpublicparticipationin rulemaking actions.In additiontoproviding opportunity to respondin writing to anNPRM and to appearand beheardat ahearing,DOTpolicy encourages agenciesto contactthepublicdirectly when we need factual information to resolve questions of substance. It also encourages DOT agenciestobe receptiveto appropriate contactsfrompersons a.ectedby orinterestedin a proposedaction.But under some circumstances an exparte contact could a.ect thebasic openness andfairness of the rulemakingprocess.Even the appearance ofimpropriety can a.ectpublic con.dencein theprocess.For this reason,DOTpolicy sets carefulguidelines forthesecontacts.Thekind of expartecontactspermitted and theprocedureswefollow depend on whenthe contact occursinthe rulemakingprocess.

What kinds of exparte contacts doesDOTpolicypermitbefore weissue an ANPRM,NPRM,SupplementalNPRM,orimmediately adopted .nal rule?
The DOT policy authorizes ex parte contacts that we need to obtain technical and eco-nomicinformation.We need thisinformationtodecide whethertoissuea regulationand what it should say. Each contact that in.uences our development of the regulation is notedinthepreamble.For multiple contactsthat are similar, we mayprovide only age-neraldiscussion.For contacts notdiscussed in thepreamble, weplace a reportdiscussing each contact or group of related contacts in the rulemaking docket when it is opened.

DoesDOTpolicypermit exparte contactsduringthe commentperiod?
No,during the commentperiod, thepublicdocketis availablefor written commentsfrom any member of the public. These comments can be examined and responded to by any interestedperson.Becausethispublicforumis available,DOTpolicydiscourages exparte contacts during the comment period. They are not necessary to collect the information the agency needs to make its decision.
6.
What if the FAA believes it needs to meet with members of the public to discuss theproposal? If the FAA determines that it would be helpful to invite members of the public to make oral presentations to it regarding the proposal, we will announce a public meeting in the Federal Register.

Are any oral contacts concerning the proposal permitted during the com-ment period? Ifyou contact the agency withquestions regarding theproposalduring the comment period, we can only provide you with information that has already been made available to the general public. If you contact the agency to discuss the proposal, you willbetold thattheproper avenue of communicationduring the commentperiodis a written communication to the docket.
