If a notice of appeal is not .led from the order of compliance issued by a Hearing O.cer, such order is the .nal agency order of compliance.

(e)
Anyperson .ling anappeal authorizedbyparagraph(a) of thissectionshall .lean appeal brief with the Administrator within 40 days after the date of the issuance of the order, and serve a copy on the other party. Any reply brief must be .led within 20 days after service of the appeal brief. A copy of the reply brief must be served on the appellant.

(f)
Anyperson .ling anappeal authorizedbyparagraph(b) ofthissectionshall .lean appeal brief with the Administrator with the notice of appeal and serve a copy on the other party. Any reply brief must be .led within 3 days after receipt of the appeal brief. A copy of the reply brief must be served on the appellant.

(g)
On appeal the Administrator reviews the available record of the proceeding, and is-sues an order dismissing, reversing, modifying or a.rming the order of compliance or the order of immediate compliance. The Administrator’s order includes the rea-sons for the action.

(h)
In cases involving an order of immediate compliance, the Administrator’s order on appeal is issued within ten days after the .ling of the notice of appeal.

Filing and service of documents under this subpart shall be accomplished in accor-dance with r13.43 except service of orders of immediate compliance under r13.81(b); and theperiods of time speci.edinthis subpartshallbe computedin accordancewith r

The o.cial who issued the notice of proposed order of compliance, for good cause shown, maygrant anextensionoftimeto .leanydocument speci.edinthissubpart, except documents to be .led with the Administrator.

(b)
Extensionsof timeto .ledocumentswith theAdministratormaybegrantedby the Administrator upon written request, served upon all parties, and for good cause shown.

FAR 13.101 : Applicability.
(a)
This subpart appliestofact-.nding investigationsinwhich an orderofinvestigation has been issued under r13.3(c) or r13.5(i) of this part.

(b)
This subpart does not limit the authority of duly designated persons to issue sub-poenas, administer oaths, examine witnesses and receive evidence in any informal investigation as provided for in sections 313 and 1004(a) of the Federal Aviation Act(49U.S.C.1354 and1484(a)) and section109(a) of theHazardousMaterials Transportation Act(49 U.S.C. 1808(a)).
