3 Appeals
3.1 Requirement
Any student who believes he has been disadvantaged by the conduct of an assessment or summative report shall have a right of appeal.
3.2 Acceptable Means of Compliance
Training providers shall establish and publish an internal appeal procedure. Training providers shall maintain records which show that students have acknowledged receipt of the appeal procedure.
3.3 Guidance
3.3.1 Students should be informed of the training provider's appeal procedure and of their right to appeal against the conduct of an assessment in accordance with CAA Regulation 6(5) of the Air Navigation Order, before undertaking the course.
3.3.2 A student who has attempted an assessment will not be permitted to appeal on the grounds of medical fitness.

Part 5 English Language Proficiency Assessments for

1 Assessment Schemes
1.1 Requirement
Assessment of English Language Proficiency at Expert Level (Level 6) of the ICAO Language Proficiency Rating Scale shall be undertaken by Training Centre Verifiers during a student's first initial rating course.
1.2 Acceptable Means of Compliance
1.2.1 Training Centre Verifiers need to have a good understanding of the ICAO Language Proficiency Requirements and in particular the Holistic Descriptors for Expert Level (Level 6).
1.2.2 The assessment shall be carried out as part of the practical element of the course on a simulator during an advanced exercise of the rating course.
1.2.3 If, during this assessment, a candidate does not demonstrate English Language Proficiency at the Expert Level (Level 6) of the ICAO Language Proficiency Rating scale, a further assessment must be undertaken to determine the Language Proficiency Level of the candidate. This assessment must be undertaken by an English Language Rater who has been approved to conduct such assessments by the CAA.
1.3 Requirement
Assessment of English Language Proficiency against the ICAO Language Proficiency Rating Scale shall be undertaken when: a) a student has failed to demonstrate Language Proficiency at the Expert Level
(Level 6); or b) an English Language Proficiency Endorsement at Level 4 or Level 5 held by an ATCO Licence holder is due for a renewal; c) specifically required by the CAA.
1.4 Acceptable Means of Compliance
1.4.1 The assessment process must be approved by the CAA.
1.4.2 The assessment must be conducted by two qualified English Language Raters who have been approved to conduct such assessments, one of which must be the holder of a full ATCO licence issued or recognised by the CAA.
1.4.3 The assessment is conducted in part on a simulator or in a simulated environment.
1.4.4 The assessment must elicit plain language together with both standard and non-standard RTF phraseology.
1.4.5 The assessment must be capable of differentiating between Levels 3, 4, 5 and 6 of the ICAO Language Proficiency Rating Scale.
1.4.6 The assessment must enable evaluation of all 6 elements of the ICAO Language Proficiency Rating Scale, being: pronunciation, structure, vocabulary, fluency, comprehension and interaction.
1.4.7 The assessment must enable recording against each of these 6 elements.
2 Records and Documentation
2.1 Requirement
2.1.1 The training centre must maintain records of the all Language Proficiency assessments in accordance with existing requirements for record-keeping in respect of approved course assessments.
