1.7  In accordance with Article 198 of the Air Navigation Order, ATC training providers shall be subject to certification by the CAA.
The Air Navigation Order, Article 198 - Certification of training providers and mutual recognition of training certificates:
a) A training provider must not provide training unless it has been certified:
i) by the CAA; or
ii) by a National Supervisory Authority of another Member State which has been recognised by the CAA.
b) Applications for certification to be a training provider must be submitted to the CAA where the applicant has its principal place of operation and business in the United Kingdom.
c) The CAA must issue a certificate when it is satisfied that the training provider fulfils the requirements laid down in paragraph 1 of Annex IV of the air traffic controller's directive1.
d) The certificate must specify the information set out in paragraph 2 of Annex IV to the air traffic controller's directive.
e) The function of recognising training certificates issued by another Member State in accordance with article 13 of the air traffic controller's directive is designated on the CAA
f) The CAA must recognise all certificates issued in another Member State if it is satisfied that the training provider fulfils the requirements laid down in paragraph 1 of Annex IV of the air traffic controller's directive.
g) The CAA must monitor compliance by the training provider with the requirements and conditions attached to the certificate.
h) If the CAA finds that the holder of the certificate issued by the CAA no longer satisfies the requirements laid down and the conditions attached to the certificate, it may take appropriate measures which may include the revocation of the certificate.
i)  If the CAA finds that the holder of a certificate issued in another Member State no longer satisfies the requirements laid down and the conditions attached to the certificate, it may withdraw recognition of the training certificate.
j)  The CAA must audit each training provider for which it has granted a certificate in accordance with paragraph (c) on a regular basis to guarantee effective compliance with the standards in the air traffic controller's directive and in carrying out this function may make on the spot visits to training providers.
1.8  Under the terms of Article 197 of the Air Navigation Order 2009 (as amended), ATC training courses shall be subject to approval by the CAA. The Air Navigation Order, Article 197 - Approval of courses, persons and simulators. For the purposes of this Part of the Order the CAA may: a) approve any course of training or instruction; b) authorise a person to conduct such examinations, assessments or tests as it may specify;
c) approve a person to provide any course of training or instruction; and d) approve a simulator.

2  UK CAA Safety Regulation Group – Air Traffic Standards Division
2.1  The Air Traffic Standards Division (ATSD) is responsible for:
a) establishing national training standards while ensuring compliance, where appropriate, with ICAO and European requirements;
b) undertaking the certification of training providers, approval of ATC training courses and ongoing regulatory oversight to ensure ongoing compliance with requirements and standards.
1. 'Air traffic controller's' directive means the Community Air Traffic Controller Licence Directive 2006/23/EC.

3  General Guidance for the Certification of Training Providers
3.1  Training providers will be considered for certification on the basis of information provided by them to ATSD, who may choose to undertake an audit of the organisation in order to evaluate the proposals.
3.2  Training providers seeking certification are strongly advised to have exploratory discussions with ATSD prior to making a formal application.
3.3  Only certified training providers who have been certified for the delivery of initial training, or those currently seeking certification for initial training, may submit courses of initial ATC training for ATSD approval.
