Regulating performance
The first measure introduces a system
of performance regulation through
the setting of targets. A two-tier
system will be introduced.
Community-wide targets
will be defined (through
quantified objectives in the
areas of delay, cost reduction
and flight efficiency).
They will be proposed by
a Performance Review Body
(PRB) and then approved by the
Commission (after they have sought
the formal opinion of the Single Sky
Committee).
These Community targets will then
be passed to the national supervisory
authorities that will have to define, after
proper consultation with stakeholders
(notably airspace users), national or
regional targets (at the level of functional
airspace blocks, FABs) consistent
with the network-wide targets. These
national/regional targets will also be
agreed at Community level. It is important
to realise that these targets will be
binding.
Detailed implementing rules have to
be prepared to define the mechanisms
which will be used to develop and
agree the targets. The Commission
has already started preparing these
rules with the active support of the
Performance Review Commission
(PRC) and the Performance Review
Unit (PRU).
The intention of EUROCONTROL is to
propose that the PRC acts as the PRB
on request of the Commission.
Integration of service
provision
SES I already included provisions
requesting Member States to establish
FABs, with a view to achieving the
maximum capacity and efficiency of
the European ATM network. A bottomup
approach had been retained and
no clear target date was set to implement
the provisions. It is well accepted
that this approach has not met the
expectations.
SES II keeps the bottom-up approach
but now extends the scope of FABs to
the lower airspace and sets firm obligations
to implement them no later
than three years after the entry into
force of the regulation, i.e. appromixately
by the end of 2012.
EUROCONTROL is willing to continue
offering strong support to the
Commission and Member States in
order to facilitate the integration of
service provision, notably through:
n the development of draft implementing
rules regarding the information
to be provided by Member
States before establishing and
modifying FABs;
n the development of guidance
material;
n the support to specific FABs initiatives,
on request of the Member
States concerned;
n support actions aimed at improving
the coordination between
FABs.
Network management
functions
Network management function is
another key new feature of SES II. It
aims to achieve optimal gate-to-gate
solutions through full integration of
the overall network perspective. SES II
identifies an initial list of specific areas
where actions need to be performed
at European network level to support
optimal performance. This includes
the design of a European route
network and the coordination of scarce
resources (frequency bands, radar
transponder codes). Implementing
rules will be prepared to this effect,
which EUROCONTROL will offer to
draft in support of the Commission.
These rules should, notably, define
the framework in which the functions
will have to be performed. The Agency
would then be willing to undertake
the tasks necessary for the execution
of these functions, on request of the
Commission.
SES II also puts obligations on Member
States to entrust “EUROCONTROL or
another impartial and competent
body with the performance of air traffic
flow management”. The Agency
has a long-standing experience in
this field through the CFMU and is of
course more than willing to respond to
further requests from Member States.
Further network management functions
might be added at a later stage
to support the implementation of
SESAR, such as the management of
the deployment of SESAR technologies
and the procurement of Europewide
infrastructure elements. Their
implementation will also have to be
supported by regulatory measures.
SAFETY PILLAR
EASA was created in 2002
to ensure that Europe
takes a common approach
towards a harmonised
development and an effective
implementation of safety regulations.
The SES II package includes a
revision of the basic EASA regulation
(which had already been amended
in 2008 to address aircraft operations
