A new Comunity
regulatory regime
In March 2009, the second legislative
package of the Single European Sky
(SES II) was adopted by the European
Parliament and politically endorsed
by the Transport Ministers. And it has
been recently formally adopted by
the Council.
SES II builds on the performance scheme
contained in SES I regulations adopted
in 2004. In particular, it includes a new
mechanism to set performance targets
as part of a performance scheme which
addresses the key performance areas of
safety, the environment, capacity and
cost-efficiency.
Specific features in relation to targetsetting
include:
n Community target-setting mechanisms
at both European and local
levels;

(SES II) will work and how they will be a powerful driver for optimising ATM
performance in Europe.
A new mechanism
for setting performance
targets
Single European Sky II
n European performance targets,
adopted under European Commission
authority;
n a common framework for corrective
measures, including alert
mechanisms, incentives and compliance,
to be applied by States
when targets are not met;
n national/FAB performance plans,
consisting of performance targets
and incentives.
The relevant legislation in relation
to target-setting is the SES II Framework
Regulation. Under Article 11
of this Regulation, the European
Commission may designate
EUROCONTROL to
act as the Performance
Review
Body (PRB) “to
assist the Commission, in association
with National Supervisory Authorities
(NSAs), and to assist the NSAs on
request, in the implementation of the
performance scheme”.
Let us turn now to the new
mechanisms for setting
performance targets
at both Community
and local
levels.

Targets
In accordance with Article 11.3 (a) of the
SES II Framework Regulation, Community-
wide performance targets for the air
traffic management network are to be
adopted by the European Commission,
after taking into account the relevant inputs
from NSAs at national level or at the
level of functional airspace blocks (FABs).
When the European Commission has adopted
the Community-wide targets, they
will be used by the NSAs to develop local
targets.
Local targets
Local, in this context, means “national”
or “functional airspace block” targets. As
already stated, these will be developed by
NSAs, in consultation with air navigation
service providers (ANSPs), airspace users’
representatives and, where relevant, airport
operators and airport coordinators.
The local targets are to be adopted by
the Member State(s) and sent to the
European Commission for assessment, to
ensure that they are consistent with the
Community-wide performance targets.

Assesment
of Targets
The implementing rules for the Framework
Regulation will contain criteria
for assessing whether the national or
functional airspace block targets are
consistent with the Community-wide
performance targets.
If they are not consistent, the European
Commission may ask the NSA(s) to
propose revised performance targets.
