in the face of capacity concerns,
congestion and the introduction
of new technologies.

Renewed focus on safety
Single European Sky II
The safety pillar of SES II provides for
the extension of the role of the European
Aviation Safety Agency (EASA)
to encompass safety in all aviation
sectors, including airports and ATM/
ANS safety in a “total aviation system”
approach.
EASA will become as a result the body
responsible for all aviation-safety-regulatory
aspects within the EU (and other
“EASA States”). As per the Community
institutional system (subsidiarity principle),
implementation of Community
law will primarily be the responsibility
of the Member States.
Typical safety
regulatory roles
EASA’s new responsibilities in the field
of ATM/ANS will comprise the following
areas:
n preparation of the common safety
rules, in the form of Draft Implementing
Rules submitted as “Opinions”
to the Commission;
n issuance of certification specifications,
acceptable means of compliance
and guidance material, albeit
not as an exclusive competency;
n standardisation inspections of
national competent authorities
to monitor the application of the
amended EC Regulation 216/2008
and of its Implementing Rules;
n oversight of compliance and certification
of pan-European ATM/ANS
providers as well as third-country
ANS providers operating in the EC;
n safety aspects related to the implementation
of the SES regulations
by the Commission and by the
Member States;

n in its fields of competency, conducting
functions and tasks ascribed to
EU Member States by application
of international Conventions (such
as the Chicago Convention).
EASA may also develop and finance
research in so far as it is strictly related
to improving activities in its field of
competences. When doing so, EASA
is required to coordinate with the
European Commission and Member
States.
Member States and more specifically
National Safety Authorities1 will continue
to play an essential role in ensuring
effective execution at national
level of the common safety rules established
under the EC/EASA regulatory
system, mainly through certification
and oversight tasks.
EASA’s key milestones
Following the European legislative
resolution agreed by the Parliament in
March 2009, key milestones have been
announced relating to EASA’s new
competencies in the field of ATM/ANS
and aerodromes. These are as follows
(see Figure 1):
n the publication of the extended
EASA Basic Regulation, expected
to take place after summer 2009
(following Council approval);
n the delivery of the EASA Opinion
on the initial set of Implementing
Rules (IRs) for ATM/ANS, currently
planned for 2011;
n the publication of the above IRs,
required to take place by December
2012;
n the entry into force of the provisions
of the above IRs to follow
publication or to be defined on a
case-by-case basis.
Interfaces with the
other SES II pilars
As with all new legislative material,
there will be a need to clarify and interpret
the intent of the law when developing
implementing measures. The
extension of the EASA system into the
safety regulation of aerodromes and
ATM/ANS will call for the progressive
establishment of effective interfaces
with some other areas of the SES II
package as well as with current EUROCONTROL
safety activities.
Ongoing discussions have indeed already
identified a need to ensure a
smooth, progressive and safe transition
from existing ATM safety regulatory
requirements and a well articulated
