(EUROCONTROL Notice of Proposed
Rule-Making) regulatory process. This
will ensure, in particular, that appropriate
consultation mechanisms are deployed
and that there is complete transparency
throughout all stages of development. In
addition, relevant stakeholders and other
experts will be able to participate in the
rule-making process. Draft rules will be
reviewed by the Safety Regulation
Commission to confirm that they are
acceptable from a safety perspective.
The draft EUROCONTROL Regulatory
Framework defines a consistent set of
regulatory material arranged according to
degrees of stringency, from binding rules
down to guidelines. This framework will
provide for an integrated set of documents
for the regulation of European ATM.
A formal consultation was held in 2002 on
a first version of the framework. The level
of support was very satisfactory, but
several significant comments implied the
need to amend the proposal. A revised
version will be produced accordingly.
The scope of regulations to be developed
is defined in the EUROCONTROL
Regulatory Work Programme. This work
programme is designed to ensure that
EUROCONTROL regulates ATM matters
that are in line with its regulatory goals
and political directives. These goals
have been defined in the ATM 2000+
Strategy and in the Single
European Sky. The EUROCONTROL
Regulatory
Work Programme has
been developed in
close consultation with
Agency experts and
external stakeholders.
The work programme
captures planned shortterm
regulatory measures
and also identifies possible
longer-term subjects for regulatory
action. The first EUROCONTROL
Regulatory Work Programme, approved
by the Permanent Commission in
November 2002, focuses on:
 airspace;
 air traffic flow management;
 interoperability matters, specifically
on flight data management, end-toend
integrity of aeronautical data and
Enhanced Mode S.
On the last topic, the EUROCONTROL
Regulatory Unit and Mode S Programme
supported France, Germany and the
United Kingdom in the development of a
common framework for the regulation of
Mode S Enhanced Surveillance. This
was illustrated notably by the launch of
an informative process in December
2002, to facilitate the drafting of such a
framework as a basis for individual State
legislation.
Separating
regulatory and
service provision
functions within
EUROCONTROL
2002 HIGHLIGHTS
EATMP managed the introduction of the Reduced Vertical
Separation Minima (RVSM) Programme in forty-one States,
making a significant impact on increasing airspace capacity.
The transition from the 25 kHz to 8.33 kHz channel spacing
for aeronautical communications was implemented in
twenty-six Member States, enabling improvements in ATM
operations, airspace sectoring and capacity.
In line with EUROCONTROL's efforts to harmonise
European ATM, EATMP launched the Overall ATM/CNS
Target Architecture (OATA) framework for the convergence
of individual systems and information exchange.
AGAS, the European High-Level Action Group for ATM
Safety, set up following the Lake Constance mid-air
collision, in July 2002, identified both short-term and
longer-term areas of ATM safety improvement and drafted
a pan-European action plan.
The Link 2000+ Programme for data link services in a
number of European airports and control centres finalised
discussions on interoperability, financing, safety and
performance requirements.
In line with the EUROCONTROL ATM 2000+ Strategy and
within the European Convergence and Implementation Plan
(ECIP), thirty-six Local Convergence and Implementation
Plans were prepared in 2002.

2002 - Challenging times
The year 2002 was a demanding year for
the aviation world. Still in the shadow of
September 11th, the year brought turbulence,
uncertainty and serious financial
challenges to the industry. Conditions
within European aviation were further
challenged by the Lake Constance midair
collision in July 2002. These events are
a stark reminder to us that both safety
and security are and will remain of paramount
importance.
EUROCONTROL has taken steps to
address the consequent safety and security
implications. In close cooperation with
ICAO and NATO, a number of strategic
