Civil Aviation Rule 61.105(2) - requirement to hold a current medical certificate issued under the Act.
The Director granted an exemption to named Student Pilots from the requirement in Civil Aviation Rule
61.105(2) that a person who does not hold a current pilot licence issued under Part 61 shall not fly an aircraft
solo unless that person holds at least a current Class 2 medical certificate issued under the Act, provided
that—
(a) the Student Pilot holds a current Joint Aviation Authorities Class 1 medical certificate and continues
to comply with all medical endorsements on the medical certificate; and
(b) the Student Pilot is undergoing flight training conducted by Simuflight (NZ) Ltd, and
(c) should the Student Pilot become aware of, or has reasonable grounds to suspect, any change in his or
her medical condition or the existence of any previously undetected medical condition the student
must—
(i) advise the Director of the change as soon as practicable; and
(ii) not fly an aircraft solo unless authorised to do so in writing by the Director; and
(d) the Student Pilot complies with any conditions or restrictions that may be imposed by the Director
under (c)(ii).
This exemption and schedule of named student pilots remains in effect for 6 months from the date of issue
unless the schedule is amended or the exemption is withdrawn earlier in writing by the Director.

Civil Aviation Rule 91.111(a)(2) – Documents to be carried.
The Director granted an exemption to Air New Zealand Ltd from requirement in Civil Aviation Rule
91.111(a)(2) that the flight manual must be carried in an aircraft, only with respect to Boeing B747, B767,
B737-300 and Airbus A320 aircraft operated in accordance with air operator certificate number AOC 12861
issued by the Director of Civil Aviation to Air New Zealand Ltd,

Provided that the following documents produced by Air New Zealand Ltd applicable to the aircraft type are
carried on the aircraft:
(a) for Boeing B747, B767 and B737-300 operations:
(i) Operations Manual Volume 1;
(ii) Quick Reference Handbook;
(iii) Performance Manual;
(b) for Airbus A320 operations:
(i) Flight Crew Operations Manual Volume 2;
(ii) Flight Crew Operations Manual Volume 3;
(iii) Quick Reference Handbook.
This exemption remains in effect unless withdrawn in writing by the Director.

Emergency Rule making activity
Under section 31 of the Civil Aviation Act the Director may make emergency Civil Aviation Rules as may be necessary
to alleviate or minimise any risk of the death of or serious injury to any person, or of damage to any property.

Rule making activity
The statutory power to make Civil Aviation Rules rests with the Minister of Transport under Part 3 of the Civil
Aviation Act 1990. The CAA is contracted to the Ministry of Transport to develop Rules for the Minister.
Under the contract the Minister of Transport approves a programme of new Rules, and changes to existing
Rules for the financial year. The programme is based on the CAA proposals and proposals from other
interested parties.

Docket 1/CAR/1358- Agricultural Aircraft Operations
The Associate Minister of Transport signed the following Rule amendments on November 4. The rule will
come into effect on 12 December 2003
Part 137 Re-issue, and
Part 1 Amendment 24
The changes proposed provide additional requirements and exceptions to the general operating rules for the
conduct of agricultural aircraft operations within New Zealand.
Part 1 provides the definition of what is meant by agricultural aircraft operations.

The Associate Minister of Transport signed the following Rule amendment on November 4. The rule will
come into effect on 12 December 2003

The objective of Amendment 5 to Rule Part 19 is to prescribe conditions for the use of Global Positioning
System (GPS) derived distance information during a precision instrument approach.
Petitions for Rule making
98/PET/54 New Zealand Air Line Pilots’ Association – One level of safety
The New Zealand Air Line Pilots’ Association (NZALPA) submitted a petition dated 18 December
1997 to propose that the scope of Part 121 be widened to include all aeroplanes having 10
passenger seats or more.
This petition with relevant CAA comment was published in the CARRIL on 4 September and 2 October
2003, with the comment period open until 31 October 2003.
