Notice of Proposed Rule Making (NPRM)
Docket 98/CAR/1304–NPRM 04-01 Designation and Classification of Airspace
CAR Part 71–Designation of Airspace
CAR Part 73–Special Use Airspace
Purpose of NPRM:
• Combine Parts 71 and 73 into one Part.
• Propose changes to various airspace designation and classification rules, including an expansion of
the criteria for the Director to designate transponder mandatory airspace to allow for the more
effective use of airborne collision avoidance systems (ACAS).
• Incorporate changes to airspace terminology arising from harmonisation discussions with the Civil
Aviation Safety Authority Australia (CASA).
This proposal also includes consequential airspace related amendments to other Parts, and makes editorial
changes to rules 91.307 and 91.311.

Key Issues
The proposal will:
• Reduce the number of airspace rules
• Reduce the number of special use airspace types
• Introduce common terminology as a consequence of airspace terminology harmonisation
discussions with CASA
• Clarify the intent of certain airspace related rules
• Raise the transition altitude
• Extend the criteria for the Director to designate transponder mandatory airspace to provide for the
more effective use of ACAS
• Remove differences between Part 71 and ICAO Annex 11.
Consultation
Considerable public and industry consultation on various issues has already taken place prior to and during
the development of this NPRM. This consultation included:
• The public consultation that took place on the original NPRM 99-5 issued in 1999, and the
consequential meetings and discussions with GNZ and ACNZ
• The airspace harmonisation discussions that took place with CASA over the period December 2000
to July 2001
• Discussions on transponder mandatory airspace during the Part 121 and Part 125 ACAS rules
development projects during 2001 and 2002
• The extensive consultation that took place with various aviation user groups and industry
representatives during 2001/02 in association with the Airspace Review conducted by the CAA
Aeronautical Services Unit.
NPRM 04-01 was first notified in a special edition of the CARRIL on 16 October 2003 and is available on
the CAA web site and on request to the Docket Clerk.
Comments on this NPRM should be sent to the Docket Clerk by 14 November 2003

CIRAG
CIRAG is the acronym for the joint Civil Aviation Authority (CAA) and Industry Rules Advisory Group. It is
part of the Rule making process to involve industry representation in the development of new or amended
Rules. Details about CIRAG’s structure and mechanism are available on the CAA web site
http://www.caa.govt.nz under the Rules & more heading, or from the Docket Clerk.
The CIRAG Executive consists of three AIA/industry members Wayne Taylor, Geoff Eban and John
Funnell; and three CAA members, Steve Douglas, Peter Blackler and the relevant General Managers of
Airlines, General Aviation or Personnel Licensing and Aviation Services Groups.
The CIRAG Executive last met on 2 October 2003 to review the progress of the various Technical Study
Group (TSG) projects. The Minutes of the 18th Meeting of the CIRAG Executive held on 2 October 2003
will be available on the web shortly. The next meeting of the CIRAG Executive is scheduled for 18th
December 2003.
