The GS’S CORNER
This month, we will hear if the European Union agrees
to open accession talks with Turkey, taking the republic
one step closer in its bid to join the EU. Indeed,
Turkey is already part of Europe and should also be a member
of the Union.
Turkey’s Muslim culture and heritage is not a good reason
to keep it out. On the contrary, the strength of the European
Union must build on the diversity of many cultural components.
However, there are a number of reasons not to
grant Turkey membership of the EU at this time. Here I
will mention a few that are fundamental from a trade union
point of view.
Turkey ratified ILO convention no. 87 on freedom of association
in 1993 and no. 98 on collective bargaining in 1952.
Furthermore, Turkey has ratified the Declaration on Fundamental
Principles and Rights at Work of 1998. Ratification
of international laws implies changes in national legislation
to incorporate the wording and the spirit of what has
been agreed at an international level.
Turkish governments that have ruled the country in the
last few decades have not achieved these obligations, nor
have they made any efforts to do so. Labour legislation in
Turkey is discriminatory and unfair.
To join a union as an individual is very difficult. To form a
trade union is even worse. First, you have to prove that you
represent at least 50% of the workers at the site you want
to organise. Second, you have to prove that you represent
at least 10% of the workers in the entire sector you operate
in. Not easy, when the government relies on figures
provided by the company or employers’ association. This is
without mentioning the restrictions that exist preventing
strikes.
During the last decade, the IMF and many other international
trade unions have filed complaints with the ILO
against Turkish governments for having violated ILO
conventions on several occasions. In this time, the Turkish
government has never given the ILO any explanation as to
why the Turkish labour laws remain as they do.
The European Parliament, the European Commission and
the European Council have all put pressure on the Turkish
Government to force new legislation in terms of human
rights for minority groups, as well as to abolish the death
penalty. Undoubtedly, some positive results have been
achieved. However, in terms of labour legislation, the situation
is still far from acceptable.
The Turkish government must
introduce all the necessary changes
in the national labour laws, in
line with international legislation,
before any negotiations to join the
EU begin.
