required to obtain the permission from the competent authorities of
the General Administration of Civil Aviation of China.
1.6 外國民用航空器的經營人，不得經營
中華人民共和國境內兩點之間的航空運輸。
1.6 No operator of foreign civil aircraft shall operate the air
transport between two points in the People's Republic of China.
1.7 外國民用航空器在進出中華人民共和
國領域時和在中華人民共和國領域內飛行, 必
須遵守中華人民共和國一切有關法律、法規和
規章 。
1.7 When entering/leaving or staying in the territory of the
People's Republic of China or operating therein, a foreign civil
aircraft shall observe all the relevant laws, rules and regulations of
the People's Republic of China.
1.8 外國民用航空器在中華人民共和國領
域內飛行, 除非事先經中國民用航空總局特許,
不得載運軍火, 作戰物資和中國民用航空總局
規定的其他禁運物品。
1.8 No arms and ammunition, war materials and other
contraband articles stipulated by the General Administration of
Civil Aviation of China are allowed to be carried on a foreign civil
aircraft operating in the territory of the People's Republic of China,
unless it has obtained special authorization from the General
Administration of Civil Aviation of China in advance.
1.9 外國非民用航空器除非經中華人民共和
國政府特許并遵守該項特許條件, 不得飛入或
者飛出中華人民共和國領域和在中華人民共和
國領域內飛行。
1.9 Unless it obtains special permission from the People's
Republic of China and meets the requirements thereof, a foreign
non-civil aircraft is not allowed to enter or leave the territory of the
People's Republic of China or make flights therein.
1.10 出入中國國（邊）境的航空器，必須經
由對外開放口岸通行，并接受邊防檢查。
1.10 For exit from or entry into the boundary (frontier) of the
People’s Republic of China, aircraft shall pass through the airport
available for foreign operators and subject themselves to frontier
inspection.
1.11 航空器應在設立海關的地點降落和起
飛，并應當向海關如實申報。進出境航空器，
由于不可抗力的原因，被迫在未設立海關的地
點降落、起卸貨物、物品，航空器負責人應當
立即報告附近海關。
1.11 Aircraft shall land or take off at a place where a Customs
office is located and shall make truthful declaration to the Customs.
When an aircraft is forced, due to force majeure, to land and
discharge goods or passengers’ luggage at a place without a
Customs office, the person in charge of the aircraft shall notify
immediately the nearest Customs office.
1.12 航空器應當接受海關檢查。海關對航
空器實施檢查時，其負責人應當到場，并根據
海關的要求開啟艙室；有走私嫌疑的，還應當
開拆可能藏匿走私貨物、物品的部位。
1.12 Aircraft shall be subject to Customs inspection. When
Customs carry out such inspection, the person in charge shall be
present and open holds at the request of the Customs. When
smuggling is suspected, the person in charge shall dismantle the

section where smuggled goods or articles may be concealed.
2. 定期航班 2. Scheduled flights
2.1 總則 2.1 General
2.1.1 外國民用航空器根據中華人民共和國
政府同該國政府簽訂的航空運輸協定,可以在
中華人民共和國境內按照協定中規定的航線進
行定期航班飛行和加班飛行。
2.1.1 A foreign civil aircraft is permitted to operate scheduled
services and additional flights in the territory of the People's
Republic of China in accordance with the air transport agreement
concluded between the Government of the People's Republic of
China and the Government of the State concerned on routes
specified in the agreement.
2.1.2 中國民用航空總局在收到外國航空公
司申請或延長經營許可的書面材料后，根據有
關航空協定、協議、會談紀要、備忘錄及中國
的有關法律、法規，于一個月內作出批準或不
批準的答復。
2.1.2 Pursuant to the relevant air services agreement, agreed
arrangements, record of discussion, Memorandum of
Understanding and relevant Chinese laws and regulations, CAAC
will make a reply of approval or disapproval within one month
after receiving a written application with necessary documents
from a foreign airlines for operating permit or for renewal of
operating permit.
2.1.3 中國民用航空總局頒發給外國航空公
司的經營許可不得被涂改、轉讓、租賃、買
賣。
2.1.3 Operating permit issued by CAAC shall not be altered,
transferred, leased, bought or sold.
2.1.4 定期航班,應當按照班期時刻表進行。
班期時刻表必須由同中華人民共和國政府簽訂
協定的對方政府指定的航空運輸企業, 預先提
交中國民用航空總局, 并且征得同意。
2.1.4 A scheduled flight shall be conducted in accordance with
