3.1.8 外國(guó)民用航空運(yùn)輸企業(yè)不得經(jīng)營(yíng)中華

3.1.8 No foreign air carrier is allowed to operate non-scheduled
flights for carriage of commercial traffic originating in one point
within the territory of the People’s Republic of China and destined
for another point in the same territory.

3.1.9 對(duì)外國(guó)民用航空運(yùn)輸企業(yè)經(jīng)營(yíng)取酬運(yùn)
輸業(yè)務(wù)的不定期飛行，中國(guó)方面有權(quán)收取航空
業(yè)務(wù)權(quán)補(bǔ)償費(fèi)。
3.1.9 The Chinese Authorities have the right to levy
compensation charges for the grant of air traffic right on foreign air
carrier operating non-scheduled flights for carriage of such traffic
in passengers, baggage, cargo or mail as originate from the
People’s Republic of China and destined for another point in the
same territory.
3.1.10 除經(jīng)中國(guó)民用航空總局特準(zhǔn)者外，從
事非取酬的不定期飛行的外國(guó)航空器，只能飛
抵中華人民共和國(guó)領(lǐng)域內(nèi)的一個(gè)指定地點(diǎn)，并
不得載運(yùn)非該航空器的原載人員或者原載貨物
飛出中華人民共和國(guó)領(lǐng)域，也不得將原載人員
或者原載貨物留在中華人民共和國(guó)領(lǐng)域內(nèi)。
3.1.10 Unless with special permission of the General
Administration of Civil Aviation of China, foreign aircraft engaged
in non-scheduled flight for non-remuneration purpose can land at
only one destined point in the territory of the People’s Republic of
China, and shall neither leave in the said territory the person or
cargo originally carried thereinto by the aircraft nor carry the
original person or cargo thereout.
3.1.11 從事不定期飛行的外國(guó)民用航空器，
在中國(guó)境內(nèi)，由中國(guó)民用航空總局批準(zhǔn)的有關(guān)
服務(wù)部門(mén)提供地面服務(wù)，不得由在中國(guó)境內(nèi)的
外國(guó)企業(yè)或個(gè)人提供服務(wù)。
3.1.11 Ground handling services provided in China to the
foreign civil aircraft engaged in non-scheduled flight shall be taken
by the concerned service company approved by CAAC. Any
foreign company or individuals in China are not allowed to provide
such services.
3.1.12 中國(guó)民用航空總局對(duì)可能危害公眾利
益的不定期飛行，可規(guī)定其他附加條件。
3.1.12 The General Administration of Civil Aviation of China
may set other additional conditions on the operation of nonscheduled
flight which may endanger public interests.
3.1.13 從事國(guó)際運(yùn)輸?shù)牟欢ㄆ陲w行的航空
器，必須按照中華人民共和國(guó)有關(guān)規(guī)定辦理邊
防、海關(guān)、衛(wèi)生檢疫和安全檢查等項(xiàng)手續(xù)，并
按規(guī)定繳付費(fèi)用。
3.1.13 In accordance with relevant regulations of the People’s
Republic of China, aircraft engaged in non-scheduled international
flights shall complete the formalities relating to frontier inspection,
customs, health, quarantine and security and shall be subject to
charges according to relevant regulations.
3.1.14 從事不定期飛行的外國(guó)航空器及其機(jī)
組成員和所載旅客、行李、貨物和郵件進(jìn)出中
華人民共和國(guó)領(lǐng)域和在中華人民共和國(guó)領(lǐng)域
內(nèi)，必須遵守中華人民共和國(guó)有關(guān)法律、法規(guī)
和規(guī)章，并按規(guī)定繳付各項(xiàng)費(fèi)用。
3.1.14 Foreign aircraft engaged in non-scheduled flight, its crew
members and the passengers, baggage, cargo and mail carried
thereon shall, while entering, within or leaving the territory of the
People’s Republic of China, observe all relevant laws, rules and
regulations of the People’s Republic of China and pay dues,
charges and fees according to relevant regulations.
3.1.15 從事不定期飛行的外國(guó)航空器的經(jīng)營(yíng)
人，必須投保該航空器在中華人民共和國(guó)領(lǐng)域
內(nèi)飛行時(shí)對(duì)地面第三者造成損害的責(zé)任險(xiǎn)；如

3.2.1 民用航空器執(zhí)行的飛入或飛出中華人
民共和國(guó)領(lǐng)域運(yùn)輸業(yè)務(wù)的不定期飛行，應(yīng)當(dāng)按
照中華人民共和國(guó)同該航空器所屬的空運(yùn)企業(yè)
所在國(guó)政府簽訂的航空運(yùn)輸協(xié)定中有關(guān)規(guī)定辦
理或至少提前15 天向中國(guó)民用航空總局申請(qǐng)
