2.2.3 外國航空公司申請延長經(jīng)營許可須在
該經(jīng)營許可有效期屆滿前45 天向中國民用航
空總局書面提出；申請書由航空公司總部或其
駐華辦事處負責人簽發(fā)，一式兩份，使用中文
或英文。
2.2.3 Any foreign airlines shall submit to CAAC a written
application letter for renewal of Operating Permit at least 45 days
before the Permit is expired. The application letter shall be signed
by the responsible person from the airlines’ head office or the
airlines representative office in China. The letter shall be made in
duplicate either in English or Chinese.
2.2.4 申請延長經(jīng)營許可時須提交下列文
件：
2.2.4 Application for renewal of Operating Permit shall be
furnished with the following documents:
a. 需延長的原經(jīng)營許可；
b. 由該國至中國協(xié)議航線的航班表；
c. 如在申請延長經(jīng)營許可時，原航線的班
次、班期時刻、及使用的機型等經(jīng)營條件
發(fā)生了變化，應提供與此有關的文件。
a. The Operating Permit to be renewed;
b. Flight schedules on the specified route(s) between the country
and China;
c. If the frequencies, scheduled times, type of aircraft or other
operation conditions on the specified route(s) have changed at
the time of renewal of Operating Permit being applied,
documents related to such changes shall be submitted.
3． 不定期飛行 3． Non-scheduled flights
3.1 總則
3.1 General
3.1.1 本款關于民用航空運輸不定期飛行的
類別主要包括：自用包機、學生或?qū)W習團體包
機、綜合旅游包機、社團包機、貨物包機、專
機等。
3.1.1 Categories of non-scheduled flights in civil air transport
included in this article are own Use Charter, Student or Educational
Group Charter, Inclusive Tour Charter, Affinity Charter, Cargo
Charter and Special Flight.
3.1.2 外國民用航空器的經(jīng)營人經(jīng)其本國政
府批準，并獲得中國民用航空總局批準，方可
經(jīng)營中華人民共和國境內(nèi)一地和境外一地之間
的不定期航空運輸。
3.1.2 The operator of a foreign civil aircraft may operate nonscheduled
air transport between a place within the territory of the
People's Republic of China and a place without said territory only
after he has been approved by his own government and by the

3.1.3 從事不定期飛行，必須遵守中國民用
航空總局制訂的運輸規(guī)則，并不得影響定期航
班的正常經(jīng)營。
3.1.3 The operation of non-scheduled flight shall be subject to
the rules of the air transport prescribed by the General
Administration of Civil Aviation of China and shall not affect the
normal operation of scheduled services.
3.1.4 外國民用航空器在有定期航班的航線
或航段上不得從事不定期飛行。中國民用航空
總局局長或其授權(quán)的其他人員根據(jù)定期航班的
實際情況和條件及其他原因特準的除外。
3.1.4 Under the actual situation and conditions of scheduled
flight as well as other reasons, no foreign civil aircraft is permitted
to engage in non-scheduled flight on route or sector of a route
where scheduled flight is being operated, unless with special
authorization of the Director General of the General Administration
of Civil Aviation of China or any other person authorized by him.
3.1.5 外國民用航空器的所有人或經(jīng)營人進
行不定期飛行，不得載運從中華人民共和國境
內(nèi)始發(fā)的中華人民共和國國籍的勞工出境，但
經(jīng)由中國民用航空總局局長或其授權(quán)的其他人
批準的除外。
3.1.5 The owner or operator of a foreign civil aircraft engaged
in non-scheduled flight is not permitted to carry workers with
nationality of the People’s Republic of China, unless with approval
by the Director General of the General Administration of Civil
Aviation of China or any other person authorized by him.
3.1.6 從事不定期飛行的空勤人員和航空
器，必須符合中國民用航空總局規(guī)定的條件或
技術標準，具備機組人員執(zhí)照、航空器登記
證、航空器適航證和按照有關規(guī)定應當攜帶的
證件和文件。
3.1.6 Aircraft and its crew engaged in non-scheduled flights
shall meet the criteria or technical standards stipulated by the
General Administration of Civil Aviation of China and shall
respectively possess and carry aircraft airworthiness certificate,
registration certificate and crew licenses as well as other
certificates and documents required to be carried along according
to relevant regulations.
3.1.7 外國民用航空運輸企業(yè)經(jīng)營飛入或飛
出中華人民共和國領域運輸業(yè)務的不定期飛
行，按照中華人民共和國政府和該外國政府簽
訂的航空運輸協(xié)定中有關規(guī)定辦理。
3.1.7 The operation of non-scheduled flight by a foreign air
carrier for commercial purpose into and out of the territory of the
People's Republic of China shall be subject to relevant provisions
laid down in the Air Transport Agreement, if any, between the
